Married Daughter is also part of Maternal Family, Allahabad High Court on Deceased Dependent Quota
Allahabad High Court : The Allahabad High Court has said in an important decision that even after getting married, the daughter is a part of the maternal family. The court has said this while hearing a case of job from the deceased’s dependent quota. The court said that after the death of the father, the married daughter is also entitled to get his job.
Allahabad High Court rejected CMO Meerut decision
The court has rejected the decision of the CMO of Meerut. In which he says that the daughter should not count in the maternal family after marriage. Reversing the order of the CMO, the High Court said that now is the time to change the thinking. Married daughter also comes under the definition of family. On this basis, a marrige daughter is also give a job in place of the father under the decease dependent quota.

Aruna Filed a Petition
The High Court has given this order on the petition of Aruna, who lives in Meerut’s J Block Colony. Aruna challenged the order of the Chief Medical Officer dated 11 December 2018 in the High Court. In this, the CMO had refused to give job to Aruna instead of father in the deceased dependent quota.
Aruna’s father was at government hospital
Aruna’s father died on July 4, 2018. His daughter had given a job application on behalf of the whole family to the senior officials of the government hospital in Meerut. In which it written that after the father all the responsibility of the house come on me. Because of which this job should given to me. Which the officials refused to accept and not give Aruna a job.

Allahabad High Court : Violation of the Constitution
Judge Vikram D Chauhan said in his judgment that by refusing the job, the senior officials of the government hospital have violated Articles 14 and 15 of the Constitution. The court quashed the CMO’s order and ordered Aruna to get a job in place of her father Shyamlal.
Job in Deceased Dependent Quota
Within 5 years of the death of an employee in the decease dependent quota, any member of his family isgiven a job. The UP government has given several orders regarding this. In which it has tell that after the dead of the father, the son or daughter will get a job within 5 years.
